1. Acceptance of Terms

By accessing or using the Site, submitting a contact or estimate form, or engaging Advanced Martinez Asphalt Paving to perform any service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are submitting a request on behalf of a business or organization, you represent that you have the authority to bind that entity to these Terms.

2. Description of Services

Advanced Martinez Asphalt Paving provides asphalt paving, sealcoating, repair, resurfacing, crack sealing, parking lot maintenance, grading, drainage, concrete work, and related services for residential and commercial properties primarily in Martinez, CA and surrounding Contra Costa County communities.

Use of the Site is limited to lawful purposes related to researching, requesting, or obtaining information about our services. You may not use the Site to submit false or misleading information, to harvest data, or for any purpose that violates applicable law.

3. Estimates and Pricing

All written estimates provided by Advanced Martinez Asphalt Paving are valid for 30 days from the date of issue unless otherwise stated. Estimates are based on conditions observed at the time of the on-site assessment. If site conditions change materially before or during the job - including the discovery of underground utilities, unstable base material, or other unforeseen conditions - pricing may be adjusted with prior notice.

Verbal estimates or price ranges discussed over the phone are approximations only and are not binding. A written estimate is required before any work begins.

We reserve the right to adjust pricing for material cost increases beyond our control, including changes in asphalt or fuel costs between the estimate date and the scheduled work date.

4. Scheduling and Cancellations

Work is scheduled on a first-come, first-served basis after a written estimate has been accepted. We will confirm your scheduled date in writing or by phone.

Asphalt and sealcoating work is weather-dependent. We may reschedule a job if weather conditions are unsafe or unsuitable for proper material application or curing. We will notify you as soon as possible if a reschedule is necessary and will work with you to find the earliest available date.

If you need to cancel or postpone a scheduled job, please contact us at least 48 hours in advance. Cancellations made less than 48 hours before the scheduled start time may be subject to a cancellation fee to cover mobilization and material costs already incurred, as specified in your written estimate.

5. Payment Terms

Payment terms are specified in your written estimate or invoice. For most residential jobs, payment is due upon completion of work. For larger commercial or multi-phase projects, a deposit may be required before work begins, with the balance due upon completion or at agreed milestones.

Accepted payment methods will be listed on your invoice. Invoices not paid within the agreed timeframe may accrue interest at the maximum rate permitted under California law. You are responsible for any collection costs, including reasonable attorney's fees, if payment is not made as agreed.

We reserve the right to place a mechanics lien on your property as permitted by California law if payment is not received within the agreed terms.

6. Your Responsibilities

Before we begin work, you are responsible for:

• Ensuring the work area is clear of vehicles, equipment, and personal property.
• Disclosing the location of any underground utilities, irrigation lines, or other subsurface features that could be affected by grading, paving, or excavation.
• Obtaining any required permits for the work, unless we have agreed in writing to handle permitting as part of the project scope.
• Providing reasonable access to the work area during scheduled work hours.

We are not responsible for damage to unmarked or undisclosed underground utilities, irrigation systems, or other subsurface features.

7. Warranty Disclaimers

We stand behind our work and will address workmanship defects that appear within the warranty period stated in your written estimate or project agreement. Warranty coverage, if any, is limited to defects in materials and workmanship under normal use conditions and does not cover damage caused by:

• Heavy vehicle loads exceeding the designed capacity of the surface.
• Acts of nature, including earthquakes, flooding, or extreme weather events.
• Subsurface conditions not disclosed prior to the work, including soil movement, root intrusion, or underground water.
• Damage caused by third parties after project completion.
• Normal weathering, oxidation, or wear consistent with the age of the surface.

The Site and any information on it are provided "as is" without warranty of any kind. We make no representations that the Site will be uninterrupted, error-free, or free of harmful components.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Advanced Martinez Asphalt Paving shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Site or our services, even if we have been advised of the possibility of such damages.

In any case, our total liability to you for any claim arising from or related to our services shall not exceed the amount you paid us for the specific service giving rise to the claim.

9. Dispute Resolution

If a dispute arises between you and Advanced Martinez Asphalt Paving, we encourage you to contact us first at info@martinezasphaltpaving.com so we can attempt to resolve it informally.

If informal resolution is not possible, disputes shall be resolved through binding arbitration administered under the rules of the American Arbitration Association (AAA) or a comparable arbitration body, unless both parties agree in writing to another method. You agree to waive any right to a jury trial or to participate in a class action lawsuit in connection with any dispute with us.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes not resolved through arbitration shall be brought exclusively in the state or federal courts located in Contra Costa County, California, and you consent to the personal jurisdiction of those courts.

11. Modifications to These Terms

We may update these Terms from time to time. When we do, we will revise the "Effective Date" at the top of this page. Continued use of the Site or engagement with our services after changes are posted constitutes your acceptance of the updated Terms. We encourage you to review this page periodically.
